Welcome to SolSports. These Terms of Service ("Terms") govern your access to and use of the SolSports platform, including our website, mobile applications, and all related services (collectively, the "Platform"). Please read these Terms carefully before using our Platform.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.

1. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

The Platform is not available to users in jurisdictions where online gaming, gambling, or cryptocurrency use is prohibited. It is your responsibility to ensure that your use of the Platform complies with the laws of your jurisdiction.

2. Account Registration

To access certain features of the Platform, you must create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

3. User Conduct

You agree not to use the Platform to:

• Violate any applicable law, regulation, or third-party rights
• Engage in fraudulent, deceptive, or manipulative activities
• Cheat, hack, or exploit bugs in games or tournaments
• Use multiple accounts or collude with other users
• Harass, threaten, or intimidate other users
• Post or share offensive, harmful, or inappropriate content
• Attempt to interfere with or disrupt the Platform's operation
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use automated scripts, bots, or other software to access the Platform
• Impersonate any person or entity

We reserve the right to suspend or terminate your account and access to the Platform if you violate these conduct rules or if we determine, in our sole discretion, that your use of the Platform is harmful to other users or to SolSports.

4. Tournaments and Competitions

The Platform allows users to participate in gaming tournaments and competitions. By entering a tournament, you agree to:

• Abide by the specific rules of each tournament
• Accept the results as determined by SolSports
• Participate fairly and in good sportsmanship
• Have the necessary hardware, software, and internet connection to compete
• Allow SolSports to use your gameplay data and results for promotional purposes

SolSports reserves the right to disqualify any participant who violates tournament rules or these Terms, or who engages in unsportsmanlike conduct. All tournament decisions made by SolSports are final.

5. Payments and Wallet

The Platform may require payment for certain features, such as tournament entry fees. By making a payment, you agree to:

• Provide accurate and complete payment information
• Authorize us to charge your chosen payment method
• Assume responsibility for all taxes applicable to your transactions
• Accept that certain payments may be non-refundable, as specified at the time of transaction

When you connect a cryptocurrency wallet to the Platform, you retain control of your private keys. However, you are responsible for securing your wallet and for all transactions initiated through your wallet. SolSports is not responsible for any loss of funds due to wallet security breaches that are not our fault.

6. Intellectual Property

The Platform and its content, features, and functionality are owned by SolSports and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.

By submitting content to the Platform (such as profile information, comments, or feedback), you grant SolSports a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with the Platform and SolSports' business operations.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SOLSPORTS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Platform will be uninterrupted, secure, or error-free, or that defects will be corrected. We are not responsible for any losses resulting from system failures, network issues, or other technical problems that may affect the Platform or tournaments.

Cryptocurrency transactions are irreversible and SolSports has no control over the Solana blockchain. We are not responsible for any losses due to blockchain failures, delays, or errors.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLSPORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE PLATFORM.

IN NO EVENT SHALL SOLSPORTS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO SOLSPORTS IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless SolSports and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California, unless we mutually agree to hold the proceedings elsewhere. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last Updated" date. We will provide notice of material changes as required by law. Your continued use of the Platform after the changes have been posted constitutes your acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease, but all provisions of these Terms that by their nature should survive termination shall survive.
